How do I get permission to use a sample?
Q: How do I clear a sample?
A:
To clear a sample from a sound recording, you need to get licenses from (and
most likely pay) the following parties: The owner of the sound recording
(usually the label, sometimes the production company,) the songwriters,
sometimes the producer, and the publishing company. The artist, unless
credited as a songwriter, producer, or publisher, has no say. To put it on a
record, you need a master use license AND a non-compulsory mechanical
license. To put it on TV and or film or video (including an Electronic Press
Kit) you need a master use license and a synchronization license. KEEP IN
MIND the license of a sound recording sample is not for granted, and the
owners can deny your use and/or charge you anything they decide to charge
you.
